Wrongful Death
On the anniversary of his death, the estate of David “Bones” Hebert announced it had filed suit against Sgt. Andrew Mitchell in US District Court. On the second anniversary, the suit was expanded to include Officers Johnson, Kneller and Stavale, and the City of Cincinnati.
Not only did Sgt. Mitchell err in killing Hebert, but also acting under color of law and within the context of city policy, other officers put Hebert in harm’s way with their commands and failed to render medical aid as the man lay dying.
